TERMS OF SERVICE

These Terms of Service (“Terms”) govern access to and use of galaxs.store and purchases made from LoveBaby.
By accessing the Store, submitting personalization content, or placing an order, the customer agrees to these Terms and all other policies published on the Store.

ELIGIBILITY
Customers must be at least the age of legal majority in their place of residence or have permission from a parent or legal guardian to make a purchase.
The Store may not be used for fraudulent, unlawful, or unauthorized purposes.

PRODUCT INFORMATION
LoveBaby makes reasonable efforts to display and describe products accurately.
Screen settings, lighting, photography, manufacturing variations, and digital rendering may cause minor differences in color or appearance.
The digital ultrasound pin is a sentimental display product. It is not a medical device and must not be used to diagnose, monitor, prevent, or treat any medical condition.

PERSONALIZED ORDERS
Customers are responsible for checking the accuracy and quality of all files, names, dates, messages, shipping information, and personalization instructions submitted with an order.
By submitting photographs, ultrasound images, videos, audio, names, dates, or other content, the customer confirms that:
• The customer owns the content or has permission to use it;
• Its use does not violate another person’s privacy, intellectual-property, publicity, or legal rights;
• The content is lawful and does not contain harmful material;
• LoveBaby and its production partners may reproduce and process the content solely as necessary to create, fulfill, and support the order.
LoveBaby may reject content that appears unlawful, harmful, infringing, or technically unsuitable.

ORDER ACCEPTANCE
Submitting an order does not guarantee acceptance.
LoveBaby may refuse or cancel an order because of:
• Suspected fraud;
• Payment failure;
• Inventory problems;
• Obvious pricing or product errors;
• Prohibited personalization content;
• Shipping restrictions;
• Incomplete customer information;
• Other legitimate business reasons.
If LoveBaby cancels an order after payment has been successfully collected, the amount charged for the canceled order will be refunded.

PRICES AND PAYMENT
Prices are displayed in the currency shown at checkout.
Applicable shipping charges and taxes, if any, will be displayed before the customer submits the order.
Customers agree to provide accurate, complete, and current billing and payment information.
Payments may be processed by third-party payment providers under their own terms and privacy policies.

SHIPPING AND DELIVERY
Orders are subject to the LoveBaby Shipping Policy.
Estimated processing time is 1–3 business days. Estimated transit time after processing is 4–11 business days.
Customers are responsible for providing complete and accurate delivery information.
If LoveBaby cannot ship an order within the promised period, LoveBaby will provide the notice, cancellation option, or refund required by applicable law.

RETURNS AND REFUNDS
Returns, replacements, cancellations, and refunds are governed by the LoveBaby Refund and Return Policy.
Nothing in these Terms limits a consumer right that cannot legally be waived.

INTELLECTUAL PROPERTY
Unless otherwise stated, the Store and its original text, photographs, graphics, designs, logos, videos, and other content are owned by or licensed to LoveBaby and are protected by applicable intellectual-property laws.
Store content may not be reproduced, sold, distributed, modified, scraped, or commercially exploited without prior written permission, except where legally permitted.

REVIEWS AND CUSTOMER SUBMISSIONS
When a customer voluntarily submits a review, comment, photograph, or other non-private content for publication, the customer grants LoveBaby a non-exclusive, worldwide, royalty-free license to display and use that content for Store-related and promotional purposes.
Private ultrasound images and personalization files will not be publicly used for advertising without separate permission.

PROHIBITED CONDUCT
Customers may not:
• Use the Store for fraud or unlawful activity;
• Interfere with Store security or operation;
• Introduce malware or harmful code;
• Attempt unauthorized access to systems or personal information;
• Submit content that violates another person’s rights;
• Use automated systems to scrape or overload the Store;
• Misrepresent their identity or payment authority.

THIRD-PARTY SERVICES
The Store may use or link to third-party services.
LoveBaby is not responsible for third-party websites or services it does not control. The customer’s use of those services may be governed by separate terms.

DISCLAIMER OF WARRANTIES
To the maximum extent permitted by law, the Store and its services are provided on an “as available” basis.
LoveBaby does not guarantee that access to the Store will always be uninterrupted or error-free.
Products remain subject to any express warranty displayed on the applicable product page and to consumer rights that cannot legally be excluded.

LIMITATION OF LIABILITY
To the maximum extent permitted by law, LoveBaby will not be liable for indirect, incidental, special, punitive, or consequential damages resulting from use of the Store or its products.
Where liability cannot legally be excluded, it will be limited only to the extent permitted by applicable law.
Nothing in this section excludes liability or remedies that cannot lawfully be limited, including applicable rights concerning defective, misrepresented, incorrect, or undelivered goods.

CUSTOMER RESPONSIBILITY
To the extent permitted by law, customers are responsible for claims resulting from their unlawful use of the Store, violation of these Terms, or submission of personalization content without the necessary authorization or rights.

GOVERNING LAW AND DISPUTES
These Terms are governed by the laws applicable in the State of Texas and applicable federal laws of the United States, without excluding mandatory consumer protections that apply in the customer’s state of residence.
Before initiating a formal claim, customers are encouraged to contact pinquestions@use.startmail.com so LoveBaby can attempt to resolve the matter in good faith.
Any unresolved dispute may be submitted to a court or authority possessing lawful jurisdiction.

SEVERABILITY
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect to the maximum extent permitted by law.

CHANGES TO THESE TERMS
LoveBaby may update these Terms when necessary.
The version published when an order is placed will generally govern that transaction unless a legal requirement provides otherwise.
